This is our template adoption contract for future adopters to review. We would like to stress that each horse adopted out through HTHRRS receives an adoption contract that is tailored to their individual needs. HTHRRS reserves the right to alter or amend this template at any time to better suit the needs of the horses that come through our hands.

Equine Adoption Contract
This Contract (also “Agreement”) is entered into by and between the undersigned (the “Parties” collectively; individually “Adopter” and “Seller”). In consideration of the mutual promises in this Agreement, and other good and valuable consideration, the sufficiency of which both parties hereby acknowledge, the parties agree to the following terms and conditions, intending to be legally bound:
Tera Schauer of Happy Tails Rescue Rehabilitation and Sanctuary (hereinafter “HTHRRS”), in consideration of $________ , U.S. Currency, paid and delivered by __________________(hereinafter “Adopter”, which includes his/her heirs, executors, administrators, successors or assigns), the receipt of which is hereby acknowledged, does hereby transfer and convey to Adopter the __________________ called “______________”, tattoo number ______________ under the following conditions:
For all consideration contained within this agreement, including but not limited to the sale of the horse for less than market value, the following conditions and representations shall apply and shall survive this contract and be made a part of any further sale or transfer of this horse for the life of the horse:
The level of care of the adopted horse(s) should at the very least meet the below requirements:
Horses must have at least two semi annual visits from a qualified and HTHRRS approved veterinarian. The visits shall include annual/semi annual shots, with the minimum coverage of Rabies, Tetanus, Western/Eastern Equine Encephalomyelitis and where endemic, Potomac Fever and West Nile. Others to be discussed with your veterinarian include Strangles, Influenza, Rhinopneumonitis, Botulism, Equine Protozoal Myeloencephalitis (EPM) and Equine Viral Arteritis. Special considerations should be discussed in regards to foals and pregnant mares. An evaluation of the horse's teeth should also occur upon annual examination and floating should be performed if necessary by either a skilled veterinarian or certified equine dentist. If sedation is necessary it is to be administered only by a qualified and licensed provider. __________ (initial)
Horses must be either be de-wormed rotationally with direction from a veterinarian or entered into a fecal egg count program, also directed by your veterinarian. HTHRRS prefers fecal egg counts in a low traffic barn environment as this ensures that parasites are specifically targeted by a de-worming treatment and de-wormer resistance is avoided. ___________ (initial)
It is HTHRRS preference that horses have the ability to have 24/7 turnout with access to a 3-sided shelter at the very least, however, these accommodations are not always available, and therefore we require that horses have daily turnout with access to shade for a minimum of 8 hrs barring dangerous weather. This excludes horses with special needs that require them to be kept indoors due to health reasons. Well fitting 'turn-out approved' blankets should be provided for debilitated/aged horses who need extra protection in cold weather. It should be noted that blankets can be a safety hazard and should be used cautiously. Fencing and stalls should be checked for projecting objects that may catch on a blanket and cause panic/injury. Horses should be checked frequently for body condition and warmth level in the girth area, especially in fluctuating temperatures if a blanket is used. In most cases, extra quality hay and shelter from the elements will provide enough heat energy to keep a healthy horse warm in cold temperatures. Stall areas and paddocks should be kept reasonably clean and with dry bedding in the stall/ run in area. _________ (initial)
If for any reason the horse develops signs or symptoms of illness/injury including but not limited to lethargy, moderate to severe lameness, going off feed/water, coughing, drainage, etc. a veterinarian visit is required within 24 -48 hrs depending on severity of symptoms. If diagnosis or treatment of injury cannot be covered by adopter due to financial reasons HTHRRS must be contacted immediately to discuss the course of action, in which the horse may be required to be returned to HTHRRS with $1.00 reimbursement and transportation being at the cost of the adopter. _________ (initial)
The horse must receive quality farrier care with trims at least every 8 weeks. Horses requiring hoof protection due to wearing issues should have boots or glue on shoes considered before applying nail in shoes. __________ (initial)
Horses must receive adequate quality feed and forages with access to hay/grass at least every few hours to prevent colic and ulcers. HTHRRS advocates for the use of slow feeder hay nets. Horses must be fed enough to sustain a body condition no lower than 4 and no greater than 7. In general, this means that a horse should be fed at least enough so that ribs are only faintly noticeable by eye in summer coat condition and not too much so that you cannot feel individual ribs. HTHRRS will formulate a diet plan for each horse at adoption that should be followed closely. Changes should be discussed with and approved by HTHRRS before they occur. __________ (initial)
Horses must have access to fresh clean water at all times. If in buckets, amount must equal at least 15 gal of water/ day. If in turnout, a flowing stream or non stagnant clean pond is suitable as long as the water is clean, non-contaminated by run off chemicals, and easily accessed by the horse at all times. __________ (initial)
The adopter agrees to give the horse adequate exercise, depending on the horse's individual requirements and to never work the horse beyond it's physical limitations or in a manner considered abuse or putting the horse in harm's way. ___________ (initial)
Horses/ ponies should never be made to carry more than 20-25% of their weight. ________ (initial)
Pasture containment must be safe and appropriate in size and allow for access to shade. General rules of thumb advise that pasture should be 1 acre/ horse, however smaller pasture 'tracks' that encourage movement for horses kept on small acreage with rotation are highly recommended by HTHRRS. Adopter agrees that horse shall never be contained by barbed wire or other fencing that may pose a hazard. ________ (initial)
Horses are adopted out as is and Adopter assumes all responsibility for existing or future conditions and temperaments. No warranties, express or implied, accompany the sale of this horse, including but not limited to warranty of merchantability or fitness or for suitability for a specific use. Adopter specifically understands that the HTHRRS makes no representation or warranty as to this equine’s temperament, health, breed, age, color, condition, soundness, level of schooling or fitness for a particular purpose or any representation or warranty of merchantability. Adopter understands that liability transfers to him/her as soon as the equine is handed off to the transporter who will deliver said equine to him/her. Adopter agrees to indemnify and hold harmless Tera Schauer/HTHRRS for any damage or injury caused to any person or property by the aforementioned equine at any time and any place thereafter. ________ (initial)
Adopter understands that this equine may be returned, in the same condition or better, within 30 days at the Adopter's expense with full refund of adoption fee or credit towards another adoption. After 30 days after date of adoption if Adopter wishes to no longer own said horse, return of Adoption fee is forfeited. Return of adoption fee is also forfeited if horse is returned in poorer condition than it was adopted out in. _________ (initial)
The horse shall never be raced, bred, leased, given away, traded, sold or given to a dealer or broker, nor sold other that as otherwise provided herein, nor used for experimentation of ANY kind. Situations of potential leasing or breeding must be discussed with Tera Schauer of HTHRRS and allowed only if deemed appropriate and with a separate contract of terms and conditions. If a breeding occurs, whether by accident or not, the resulting foal shall be be subject to each and every provision of this agreement as if a new agreement had been signed by both parties. HTHRRS shall be informed of such resulting foal within seven business days by certified mail. ________ (initial)
Moreover, Adopter guarantees, for consideration of $__1.00__, paid and delivered by HTHRRS to Adopter, receipt of which is hereby acknowledged, and for additional ample consideration including but not limited to receiving title to the horse today for less than market value, that if Adopter at any time decides to sell or otherwise transfer ownership of the Horse, or is at any time unable to care for the Horse, Adopter must offer HTHRRS the first option to take title and possession back of said horse. HTHRRS shall have fourteen (14) days in which to decide to exercise such right of first refusal, and shall be informed of the exact location of the horse. Any transfer of ownership must be approved by HTHRRS before the transfer occurs and all stipulations of this agreement apply to any subsequent owners. _________ (initial)
In addition, should HTHRRS not exercise this first right of refusal, Adopter further agrees not to sell or cause said horse to be sent directly or through an agent or otherwise to auction or to slaughter at any time or for any reason. This agreement and guarantee that the horse shall not be sent directly or indirectly to auction or slaughter shall be part of any future transfer agreement with regard to this horse at all times, and shall be part of any board agreement or arrangement regarding such horse. _________ (initial)
Adopter must offer HTHRRS this first right of refusal by notifying HTHRRS by certified mail to HTHRRS's below or last known address and must also make a good faith effort to reach Tera Schauer/HTHRRS by phone with regard to such intent to transfer or sell the horse. In the event that HTHRRS does not exercise such right of first refusal, Adopter must include ALL conditions and provisions of this agreement into a signed sale contract for the horse and must notify HTHRRS of any desire to transfer of the horse, with a copy of the signed sale or transfer agreement, name of purchaser/transferee, and new location of the horse. In the event that such intended transfer does not take place within 90 days of the required notice, or a new or different “adopter” or “transferee” is intended, new notice and right of first refusal must be given for any subsequent intended transfer. ________ (initial)
This agreement shall supersede any lien that a boarding or other facility or person or entity might otherwise have on said horse for payments due. In the event that Adopter must pay any funds whatsoever above and beyond the $_1.00_ agreed upon prior to exercising such right of first refusal (such as any requirement under state law or any contract to pay back board prior to retrieval of said horse), Adopter shall indemnify and defend Tera Schauer/HTHRRS for any such payments and charges. Adopter further agrees to pay HTHRRS's reasonable attorney’s fees and costs incurred in enforcing this agreement against the Adopter or other entity. __________ (initial)
If the horse dies or is gravely injured, Tera Schauer/HTHRRS shall immediately be notified by telephone and certified mail of the details and location of the horse. If the horse requires euthanasia for any reason, it will be done in a timely, humane manner by lethal injection administered by a licensed veterinarian. Extreme emergencies ONLY allow for use of a firearm by an experienced marksman. Proof of death must be provided to HTHRRS, such as a veterinarian’s invoice or written statement from a licensed veterinarian.

Tera Schauer/HTHRRS holds the right to gain access to or to recover said equine at anytime if horse is ever thought to be abused, abandoned, neglected, starved, or mistreated, etc., in any manner. The adopter agrees to abide by the Required Level of Care or the horse can and will be recovered by Tera Schauer/HTHRRS at anytime ________ (initial)
Liquidated damages provision: It is agreed by both parties that the monetary damages for the Adopter's breach of any provision of this agreement cannot be ascertained at this time. Therefore, the parties agree that the monetary compensation for any breach of this agreement shall be $5,000 plus out of pocket costs and attorneys fees. ________ (initial)
This Agreement shall be governed and construed in accordance with the laws of the State of Pennsylvania. The parties agree that any action taken to enforce this contract shall be brought in a court located in __Northumberland___ County, State of ___PA_____. ________ (initial)
